pubs.rights-statement	The Man Without a Name is a 40’00 radio documentary which investigates the campaign of a forensic patient to be identified in the media. 1. Research Background This research is in the field of journalism studies and media law. It is a fundamental principle of the rule of law that courts should be open and legal proceedings reportable by journalists (Spigelman 2005). Australia has restrictions on reporting of the cases of forensic patients (Pearson 2011). Researchers (Taylor et al., 2012, Smith and Caple 2014) argue that such restrictions conflict with open justice, and are neither in the best interests of individual patients, nor in the public interest. The research question driving this project was how to ethically broadcast the name of a forensic patient in a radio documentary. 2. Research Contribution In order to ethically balance the best interests of the patient with the public interest in open justice, this documentary develops a “mindful approach” to journalism ethics, applying the principles of the Eight-Fold Path to produce a more nuanced ethical approach, paying attention to principles such as right action and right intention (see Morton and Pearson, 2015). 3. Research Significance The radio documentary was commissioned by ABC Radio National’s Background Briefing in a highly competitive commissioning process and broadcast in April 2014. A deidentified transcript of the MHRT’s decision was published on their website as an example of how journalism and scholarly research could balance the interests of the patient with the law and the public interes	en_US
