The Book Providing in-depth coverage of each article of the Paris Agreement, this book offers a comprehensive, legal analysis of this most recent and important international instrument on climate change. This Chapter This substantive chapter critically examines the changing nature and scope of States' substantive and procedural obligations arising out of the expansive, complex ongoing development of the Paris Agreement. Given the remarkable brevity and minimal nature of the Paris Agreement itself, this framework instrument's content and operative effect are not articulated in this instrument. Instead, the Agreement’s operationalisation has been developed though the last five years’ intensive ongoing international negotiations and action. In examining the annual UNFCCC COP's travaux préparatoires, the multitude of official documents, key decisions, and outputs, including importantly the 2018 Katowice Rule Book, and reports of key subsidiary or related bodies (e.g., the IPCC, and subsidiary treaty bodies - SBSTA and SBI), this chapter illustrates the vast, complexities of this important body of international law. Drawing on the evolving nature of the lexicon of international climate change (terms and definitions), the discussion in this chapter also draws important links between existing international law treaties, other key instruments, the Paris Agreement, and subsequent developments in international climate change law. In addtion to the two highly qualified editors, this chapter has been reviewed by two other experienced international law scholars.
